Problems with List.Empty

Has anyone ever had problems using the "Query.List.Empty" in an IF ?
In this case The IF kept returning TRUE when in fact, there was 1 row.
I had to change the IF to "Query.List.Length = 0", and now it works ok.

Notes: The Query was located in the screen preparation and the IF in a screen action.

I'm using Service Studio and Service Center
I've got the same unexpected behavior! An example of it can be found in the attached file.

In this case, the result differs depending on the fact that the expression is evaluated inside or outside the scope of the (screen) action. I didn't use an IF statement but, as Gonçalo said, the problem is with the Query.List.Empty.
