Problem with webservices output parameters.

I'm creating a very simple  WS method that gets a record from database. The webservice is not a consumed SOAP Web Service. However when the record is not found, the method is retrieving an empty record on response xml, but should not be retrieving anything, without tags or records with null values (since they were not assigned). Its possible to change this behavior for output parameters in webservices?
