Terms and Conditions for OutSystems’ Events - Attendees

These Terms and Conditions (hereinafter, “Terms”), which also include and incorporate by reference OutSystems' Privacy Statement and Terms of Use, govern your registration for and participation in OutSystems’ Virtual Events and OutSystems’ Live Events, jointly designated “OutSystems’ Event(s)” or “Event(s)”, and are an express agreement between OutSystems - Software em Rede, S.A., its affiliates and subsidiaries, (hereinafter, "OutSystems”, "We," "Us," or "Our") and you as an attendee (hereinafter, “You”, “Attendee”, “Your” or “Yours”) in OutSystems’ Events.

Please note that depending on the type of Events (virtual or live) you are registered for, certain terms below may not apply.

1. EVENT AND REGISTRATIONS

You may only register for and attend the OutSystems’ Events in accordance with these Terms, so please read them carefully. To register for OutSystems’ Events, You must complete the registration process online and pay the fee or any other amounts (hereinafter, “Fee”) foreseen in the registration form available on Our website (hereinafter, “Registration”). You understand that sharing Your registration with another person(s) is prohibited and a violation of the Conduct and Behavior Guidelines described in Section 6 of these Terms, which may result in Your access to the Event being terminated.

OutSystems reserves the right to deny, limit, or cancel the registration or entry to any individual or entity for any reason, in OutSystems’ sole discretion, including, but not limited to, Your violation of the Conduct and Behavior Guidelines described in Section 6 of these Terms, and past or present failure to meet OutSystems’ standard of business conduct, false pretenses or engaging in violent, illegal, threatening or discriminatory conduct.

2. CANCELLATIONS, MODIFICATIONS, OR SUBSTITUTIONS

In case You can no longer attend OutSystems’ Event, You may cancel Your Registration directly through the email confirmation sent upon the Registration.
OutSystems’ Events programs schedule is subject to change at any time without prior notice to You, and OutSystems cannot guarantee the attendance of any sponsor, speaker or guest speaker, as well as that any scheduled event will take place. OutSystems may cancel any OutSystems’ Event at its sole discretion and at any time.
OutSystems and Our employees and vendors (hereafter, ‘Representatives’) will not be held liable if OutSystems’ Events or scheduled activities are canceled or rescheduled as a result of any issue, event or occurrence.

3. PAYMENT AND REFUNDS

In case a Fee was not required in the Registration, the OutSystems' Event is completely free, and there is no Fee to be paid to attend the Event.
If a Fee was requested in the Registration, this must be paid to attend the Event. In this case, any cancellation or refund of the Fee can be requested by You. The processing of all payments and refunds is done by a third-party provider on behalf of OutSystems. If you have any questions, please send an email to global.events@outsystems.com.

4. AGE REQUIREMENTS

Attendees must be at least 18 years of age to attend OutSystems’ Events, as well as all conference-related events to them.

5. PHOTOGRAPHY, AUDIO, AND VIDEO RECORDING

By attending You acknowledge and accept the terms of Our Image Consent form and acknowledge and agree that OutSystems has the right to capture, film, or record Your image and voice at the OutSystems’ Event, as well as the right to use, reproduce, broadcast or incorporate in any manner whatsoever, all or any portion of print screens, photographs, videos and/or audiotapes of You or Your participation in OutSystems’ Events in marketing materials and/or training materials, and for Our internal use (hereafter, “Recorded Materials”). You hereby irrevocably grant OutSystems and our Representatives a non-exclusive, perpetual, worldwide, royalty-free right and license to use in Our Recorded Materials any materials that You may submit to OutSystems (verbally or otherwise). You understand that the Recorded Materials may be substantially edited, altered, rearranged or modified.

6. CONDUCT AND BEHAVIOR GUIDELINES

6.1General. OutSystems values the participation of our community at all of OutSystems’ Events and wants all Attendees, partners, sponsors, speakers, moderators, staff, employees, and guests (hereafter, “Participants”) to have an enjoyable learning experience. We are committed to providing friendly and welcoming OutSystems’ Events for everyone, regardless of gender, gender identity and expression, age, sexual orientation, disability, marital status, physical appearance, body size, race, ethnicity, religion (or lack thereof), or technology choices. We do not tolerate harassment of any Participants in any OutSystems’ Events areas (including sessions, workshops, exhibition halls, booths, webinars, video calls, online chats, social media, and other online media or area). These Conduct and Behavior Guidelines provide Our expectations for all Participants’ behavior, as well as the consequences for unacceptable behavior in all OutSystems’ Events.

6.2Expected Behavior. Participants should be welcoming, empathetic, considerate, respectful, professional, courteous, supportive, and look out for each other. All Participants are subject and must follow these Conduct and Behavior Guidelines rules detailed in this Section 6 at all OutSystems’ Events and all conference-related events.

6.3Unacceptable Behavior. Participants should not follow a path of intimidating, harassing, abusive, discriminatory, derogatory, or demeaning conduct, offensive written/verbal comments related to gender, sexual orientation, race, religion, disability, technical skills, demeaning, discriminatory, or harassing behavior and speech and/or unethical or unprofessional conduct. All Participants must not use violent, illegal and/or sexualized images, activity, clothing/uniforms/costumes or any or other material liable to create a violent, illegal and/or sexualized environment. Participants asked to stop any unacceptable behavior are expected to comply immediately.

6.4Implications for Unacceptable Behavior. If a Participant engages in a behavior not compliant with this Section 6, OutSystems will take any action We deem appropriate or necessary, including warning the offender or expulsion from the OutSystems’ Event.

6.5Reporting. If You are being harassed, notice that someone else is being harassed, or have any other concerns, please contact a member of the OutSystems team immediately via email global.events@outsystems.com, or notify any staff member about the situation.

7. PRIVACY STATEMENT

OutSystems may collect, manage and share your information in accordance with OutSystems’ Privacy Statement and all applicable data privacy laws and regulations. In particular, based on Your consent OutSystems can share Your contact information with our event OutSystems’ selected Partners. You can check who Our selected Partners are at the event page or by accessing directly this link. You understand that Our selected Partners will be able to use Your contact information for their own marketing initiatives (sending You their promotional material, offers, and other information). Your information will be subject to the OutSystems’ selected Partners’ respective privacy statements. You may always choose to stop receiving marketing communications, at any time, through the channels provided by each Partner, as detailed in their respective privacy policies.

8. FORCE MAJEURE

In OutSystems’ Events where OutSystems is prevented from carrying out its obligations as a result of any cause beyond its control, such as but not limited to an act of God, war, natural disaster, a public health epidemic and/or pandemic, acts or threats of terrorism, civil disturbance, action by governmental entity, strikes, lock-outs, curtailments of transportation services or facilities, the failure of any third party to deliver goods or services for OutSystems’ Events, or any other situation that makes it impossible, illegal or commercially unfeasible for OutSystems to hold Events. OutSystems reserves the right to cancel or reschedule OutSystems’ Events and shall be relieved of its obligations and liabilities in connection therewith.

9. LIMITATION OF LIABILITY

OutSystems and Representatives will not be held liable to You under any theory of liability or cause of action, even if it has been advised of the possibility of such damages, for any special, consequential, indirect, incidental, or exemplary damages, or for loss of profits, revenues, opportunities and/or customers. In any case, OutSystems’ and its Representatives’ aggregate liability under these Terms shall not exceed USD $100. This limitation is only applicable to the maximum extent permitted by the applicable law.

By accepting these Terms You are confirming that you represent, warrant, acknowledge, agree, and understand them fully.

Terms and Conditions for OutSystems’ Events - Speakers

By submitting a proposal or agreeing in speaking at OutSystems’ Events, jointly designated ”OutSystems’ Event(s)” or “Event(s)”, you (hereinafter, “You”, “Speaker”, “Your” or “Yours”) represent, warrant, acknowledge, agree, and understand the following Terms and Conditions (hereinafter, “Terms”):

a)The importance of Your participation within the key-moments of the Speaker’s Journey - such as enablement session(s), technical dry-Runs and Recording or Live sessions but not exclusive - and also that this requires an investment of approximately 4 hours of their time, excluding any time preparing the presentation.

b) You are committed to providing all the deliverables requested on the correspondent deadlines shared by OutSystems.

c) You agree that, by participating in an OutSystems’ Event, You will not request any payment.

d) You are aware that certain presentations might end up being sponsored by one of OutSystems’ Partners also sponsoring the Event and there will be no financial remuneration in case the session is sponsored.

e) Your presentation will be reviewed by one of OutSystems’ Designers and a Proofreader after the Deck Submission avoiding any visual misconfigurations as well as typos. The review will be shared with You who will approve any needed changes. Once the review is approved by You, no more changes should be made.

f) OutSystems will not be held accountable for the inappropriate use of any copyright, confidentiality, publicity, or privacy right of any third party of Your presentations. In case of infringement of such third-party rights, You are solemnly responsible and shall indemnify OutSystems and/or the third party in question for any damages caused by it.

g) Your presentation materials do not contain libelous, sensitive, or otherwise unlawful material or information. Political or religious references will be evaluated and You might be requested to remove them if potentially offensive to any event attendee.

h) Your presentation materials might be available for download in PDF (as a non-editable file) during and/or after the event.

i) OutSystems reserves the right to change scheduled speaking times regardless of whether they are happening on-site, live, or broadcasted.

j) OutSystems reserves the right to rescind an accepted submission without a stated reason.

k) OutSystems reserves the right to re-purpose all recorded sessions (when recorded).
